US Judge Orders Release of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The case stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was detained in federal custody.

In her order, the court pointed out that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal proceedings involve conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
